Terms and Conditions
The terms that apply when you use the Nest Decor Vista website.
Agreement to These Terms
These Terms and Conditions apply to your use of nestdecorvista.com, which is operated by Nest Decor Vista ("we", "us" or "our"). By using the website, submitting a form or subscribing to our newsletter, you agree to these terms. If you do not agree, please do not use the website.
Permitted Use
You may use this website for lawful, personal and non commercial purposes, such as learning about our services, reading our articles and contacting us. You agree to provide accurate information in any form you submit and not to use the website in a way that could damage it, disrupt it or interfere with other users.
Prohibited Conduct
You agree not to submit false, misleading, offensive or unlawful content, impersonate another person, submit another person's information without permission, send spam or unsolicited advertising, attempt to access our systems without authorisation, introduce viruses or harmful code, or use automated tools to copy or collect website content without our written permission. We may suspend or block access for anyone who breaks these rules.
General Information Only
Our articles, guides and service descriptions are provided for general information and education. They are not professional advice for your specific home or situation. Electrical, gas, roofing, structural and similar work should only be performed by properly licensed professionals. Information about building codes, incentives, utility programmes and products may change, so please confirm current details with the relevant authority or provider before relying on it.
Estimates and Proposals
Estimates and proposals are based on the information available at the time and may change after a detailed inspection, final product choices or the discovery of hidden conditions such as water damage, termite damage, rot, corrosion from salt air or outdated wiring. All work we perform is governed by a separate written contract. If that contract conflicts with these terms, the contract will apply.
Permits, Codes and Associations
Many projects require permits, inspections or approval from a homeowners association. We obtain permits and schedule inspections for our own work as described in your contract. Homeowners are responsible for association approvals and any deed restrictions on their property, and we will provide reasonable documentation to help with those requests.
Schedules and Weather
Project schedules depend on permits, inspections, material availability and weather. Roofing, solar and exterior work may need to be rescheduled because of rain, hurricanes, tropical storms, lightning, high winds or extreme heat. We are not responsible for delays caused by events outside our reasonable control.
Access and Site Conditions
For scheduled work, homeowners agree to provide reasonable access to the property, working utilities and a clear work area, and to keep children and pets away from active work zones. Any specific access, parking, storage or clean up arrangements will be confirmed in your written contract.
Financing, Warranties and Third Parties
Information about financing and warranty plans on this website is general guidance only. Financing is provided by independent lenders and warranty plans by their providers, under their own terms and approval processes. We do not guarantee approval, interest rates or coverage. Manufacturer warranties are provided by manufacturers, and any workmanship warranty we offer is set out in your written contract.
Intellectual Property
The content on this website, including text, graphics, logos and design, belongs to Nest Decor Vista or its licensors and is protected by intellectual property laws. Some photographs are used under licence from their owners. You may share links to our pages, but you may not copy, reproduce, modify or republish our content without our written permission.
Information You Send Us
When you send us messages, photos, plans or other materials, you confirm that you have the right to share them and allow us to use them to respond to you and prepare estimates. We handle personal information in line with our Privacy Policy.
Electronic Communications
By using the website or contacting us, you agree that we may communicate with you electronically, including by email and through notices on this website, and that electronic communications satisfy any legal requirement for written communication, unless the law requires otherwise.
Third Party Links
Our website may contain links to other websites, embedded maps and social media platforms that we do not control. We are not responsible for their content, availability or privacy practices, and you visit them at your own risk.
Website Availability
We aim to keep the website available and accurate, but we do not guarantee uninterrupted access or that the website will be free of errors or viruses. We may change, suspend or remove any part of the website at any time without notice.
Disclaimer
The website and its content are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non infringement.
Limitation of Liability
To the fullest extent permitted by law, Nest Decor Vista will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or business, arising from your use of, or inability to use, the website or its content. Nothing in these terms limits liability that cannot be limited under applicable law.
Licensing, Permits and Local Requirements
Construction contractors in Florida are licensed through the Florida Department of Business and Professional Regulation and the Construction Industry Licensing Board, and electrical work is performed by contractors licensed under the Electrical Contractors' Licensing Board. You can verify a licence through the Department's online search. Building permits and inspections in Melbourne are handled by the City of Melbourne, and in unincorporated areas by Brevard County. Work must meet the Florida Building Code, including wind design requirements for windows, doors, roofing and solar equipment. Consumer transactions are also subject to the Florida Deceptive and Unfair Trade Practices Act, and residential construction contracts in Florida include certain notices required by state law, such as information about the Florida Homeowners' Construction Recovery Fund and construction lien rights.
Information on this website is general and does not describe the specific requirements for your property. Design advice is provided for planning purposes only, and any construction work we perform is described in a separate written contract that sets out responsibilities for permits, approvals and inspections.
Indemnification
You agree to indemnify and hold harmless Nest Decor Vista and its owners, employees and partners from any claims, losses, damages and expenses, including reasonable attorney fees, arising from your misuse of the website or your breach of these terms.
Governing Law and Venue
These terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising from these terms or your use of the website shall be brought exclusively in the state courts located in Brevard County, Florida, or the federal courts serving that county, and you consent to the jurisdiction of those courts.
Severability and Entire Agreement
If any part of these terms is found to be invalid or unenforceable, the rest will remain in full effect. Our failure to enforce any provision is not a waiver of our right to do so later. These terms and our Privacy Policy form the entire agreement between you and us about your use of the website.
Changes to These Terms
We may update these Terms and Conditions from time to time. Changes take effect when they are posted on this page with a new revision date. If you continue to use the website after changes are posted, you accept the updated terms.
